Welcome to Primpter ("Company", "we", "our", "us"). These Terms and Conditions govern your use of our website located at primpter.com and our services for generating AI artwork and ordering premium framed prints.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Definitions

• "Service" refers to the primpter.com website, AI art generation tools, and print ordering services.
• "User" refers to any individual who accesses or uses the Service.
• "Content" refers to any images, text, or other materials generated through or uploaded to our Service.
• "Order" refers to any purchase of printed products through our Service.

3. User Accounts

To use certain features of our Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We reserve the right to terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. AI-Generated Content

4.1 Ownership

Images generated using our AI tools are licensed to you for personal and commercial use, subject to the following conditions:

• You may use generated images for personal projects, commercial products, and marketing materials
• You may not claim exclusive ownership of the underlying AI model or algorithms
• Similar or identical images may be generated for other users using similar prompts

4.2 Prohibited Content

You agree not to generate or attempt to generate content that:

• Is illegal, harmful, threatening, abusive, or defamatory
• Infringes on intellectual property rights of third parties
• Contains sexually explicit or pornographic material
• Promotes violence, discrimination, or hatred
• Depicts real individuals without their consent
• Could be used for fraud, deception, or misinformation

4.3 Content Monitoring and Enforcement

We reserve the right to review, monitor, and moderate all content generated through our Service, including text prompts and AI-generated images. This review may be performed manually by our team or through automated systems. If we determine that content violates these Terms, we may, at our sole discretion:

• Flag or remove the content in question
• Issue a warning to your account
• Temporarily or permanently suspend your account
• Report illegal content to the appropriate authorities

We aim to apply content policies fairly and consistently. If you believe an action taken against your content was in error, you may contact us at legal@primpter.com to request a review.

5. Orders and Payments

5.1 Pricing

All prices are displayed in the applicable currency and include applicable taxes unless otherwise stated. Prices may change without notice.

5.2 Payment Processing

Payments are processed securely through Stripe. We do not store your full payment card details. By placing an order, you authorize us to charge the payment method provided.

5.3 Order Confirmation

After payment, you will receive an order confirmation email. This confirmation constitutes a binding contract between you and Primpter.

5.4 Production and Shipping

Products are manufactured by our print partner, Gelato. Production typically takes 2-5 business days, and shipping times vary by location. Estimated delivery times are provided at checkout but are not guaranteed.

6. Returns and Refunds

6.1 Right of Withdrawal (EU Consumers)

As per EU Consumer Rights Directive, you have the right to withdraw from a contract within 14 days without giving any reason. However, this right does not apply to:

• Custom or personalized products made to your specifications
• Products that are produced specifically based on your AI-generated designs

6.2 Damaged or Defective Products

If your product arrives damaged or defective, please contact us within 14 days of receipt with photos of the damage. We will arrange for a replacement or full refund at no additional cost.

6.3 Refund Process

Approved refunds will be processed to the original payment method within 14 business days.

7. Intellectual Property

The Service, including its original content (excluding user-generated content), features, and functionality, is owned by Primpter and protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Primpter shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims shall not exceed the amount you paid for the specific order giving rise to the claim
• We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control

9. Indemnification

You agree to indemnify and hold harmless Primpter, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of the member state where Primpter is established, without regard to conflict of law provisions.

For EU consumers, mandatory consumer protection laws of your country of residence will apply where they provide greater protection.

11. Dispute Resolution

In case of disputes, we encourage you to contact us first to seek an amicable resolution. EU consumers may also use the European Commission's Online Dispute Resolution platform: EU Online Dispute Resolution

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
